It is important to remember that this authority is focused on allowing the government to conduct intelligence collection targeting foreigners located outside of the United States. I'm going to say that again, Mr. Speaker. Targeting foreigners located outside of the United States. And not on Americans located in the United States or anywhere else in the world. Third, the FAA (Foreign Intelligence Surveillance Act Amendments Act) is subject to a robust oversight structure including Congress.

This is really important. The National Security Agents is not listening to Americans’ phone calls and is not reading Americans’ e-mails. None of this programs allow that and, as a matter of fact, the Patriot Act and that part of that 702 says it is expressly prohibited by law that you can read and wholly surveil domestic e-mail traffic in the United States. So, you know, the inflammatory nature of the comments doesn't fit with what Dianne and I know this program really does.

I’m going to tell you as strongly as I can. The National Security Agency is not reading American’s e-mail. They are not collecting Americans’ e-mails by either of these programs. I've heard it repeated by members of Congress and the Senate. I've heard it repeated in news outlets. That is absolutely incorrect.

If you're going to connect the dots on a 9/11 style event or hopefully prevent a 9/11 style event you have to have dots in the box in order to connect so all of this is just that little bit of information that they might need, a phone number to a phone number with no names attached. If it goes beyond that then it has to go to the FBI if it's an American citizen for what we would understand is the normal investigative route that would require a warrant.

I've got to tell you I hope we don't decide that our national security interest is determined by a high school dropout who had a whole series of both academic troubles and employment troubles. We have better ask a lot harder questions about who he is and what his motives were, fully, and what access he had to information before we draw the conclusion that this guy was doing something positive.

get a declassification of information that I think will allow the American public to better understand it. I can't tell you how strong we need to make this clear. The NSA is not listening to Americans' phone calls, and it is not monitoring their e-mails. If it did, it's illegal. It's breaking the law. >> (Host) right. And it's not recording them either? >> I could go get a warrant on a criminal case, (in answer to host question) yeah, absolutely. (continuing) It's very, very different. I think they think there's this mass surveillance of what you're saying on your phone call and what you're typing in your e-mails. That is just not happening.

Rogers: Does the technology exists at the NSA to flip a switch by some analyst to listen to American’s phone calls or read their e-mails? Alexander: no. Rogers: So the technology does not exist for any individual or group of individuals at the NSA to flip a switch to listen to Americans' phone calls or read their e-mails? Alexander: that is correct.

Rogers: They should use every legal avenue we have to bring him back to the united states. And listen, if he believes that he's doing something good -- by the way, he went outside all of the whistleblower avenues available to anyone in this government, including people who have classified information. We get two or three visits from whistleblowers every single week in the committee. And we investigate every one thoroughly. He didn't choose that route. If he really believes he did something good, he should come back and face the consequences of his actions.
